“From what I can gather, the copyright infringement at issue here began with CGI renderings made to promote the refurbishing of The Photographers’ Gallery. The images were produced in part by the Ireland based architectural firm of O’Donnell + Tuomey. Along with large posters that wrapped around the Ramillies Street building, my photograph of the woman was printed in leaflets and distributed to passersby. In addition, the photo was used by the gallery’s own press office for their public relations campaign in relation to the renovation. The CGI renderings, including the image with my photograph, were distributed via the media, the architects’ own website and numerous others that carried the high profile and controversial redevelopment, including online and print magazines such as The Londonist, The Architect’s Journal and more, some of which allowed users to email the content. The Londonists’ article alone had 1,958 views prior to the issuing of the takedown order. Let me be clear that I do not blame the media for distributing the copyrighted image. How could they know? Ultimately, it is The Photographers’ Gallery and the architects, Ms. Sheila O’Donnell and Mr. John Tuomey, who must face up to the unauthorized use of my photography, and possibly, many more.”
Well…it seems they all have, at last. I’m glad John’s happy. About time..
“I am pleased to announce that the Ireland based architectural firm of O’Donnell + Tuomey and I have settled. In addition to my receiving a modest financial settlement, Mr. John Tuomey apologized on behalf of the organization’s use of my photograph and explains that this infringement was an oversight and will not happen again. As a reminder, O’Donnell + Tuomey requested a print of ‘Porcelain’ for their studio. In addition, as part of the settlement, the architects agreed to make a monetary donation to the Association of Photographers (AOP), a London based non-profit, whose aim, in part, is to support the rights of photographers.”
